These FAQs explain how copyright complaints, counter-notifications, product removals, and related intellectual property disputes are handled by WPBay.

I think someone on WPBay is infringing my copyright. What should I do?

If appropriate, you may first contact the seller through their WPBay profile or product support channel. The issue may result from a misunderstanding, an incorrect attribution, or a licence that can be clarified directly.

You are not required to contact the seller before submitting a DMCA takedown notice. If direct communication is unsuccessful or inappropriate, follow the instructions in our DMCA and Intellectual Property Notice Process.

A DMCA notice is a serious legal statement. Before submitting one, make sure you own the relevant exclusive copyright right or are authorised to represent the owner. Consider whether the disputed use may be licensed, open source, in the public domain, or permitted by a legal exception.

The seller has not responded or refuses to remove the content. What can I do?

You may submit a formal DMCA takedown notice to support@wpbay.com.

Your notice must identify your copyrighted work, the exact WPBay content being reported, its URL, your contact information, an explanation of the alleged infringement, the required legal statements, and your physical or electronic signature.

WPBay may ask for additional information if it cannot identify the disputed material or verify your authority to submit the notice.

Why do I need to submit a formal DMCA notice?

Only a court or other competent authority can make a definitive legal determination about whether copyright infringement has occurred.

WPBay operates the marketplace but does not own the products submitted by independent sellers. A formal notice gives us the information and legal statements needed to identify the content, notify the affected seller, and take appropriate action without attempting to decide the complete dispute ourselves.

Will WPBay immediately remove a product after receiving a complaint?

WPBay will review whether the notice substantially contains the information required by the DMCA. If it does, we will generally remove or disable access to the disputed content promptly and notify the affected seller.

If important information is missing, we may ask the claimant to correct or complete the notice before action is taken.

Removing content does not mean WPBay has made a final legal determination that infringement occurred.

Why does the seller receive a copy of my notice?

The complaint concerns content supplied by that seller. The seller must be told what was reported and given an opportunity to understand the claim, resolve it directly, remove the disputed content, or submit a counter-notification.

A copy of the notice will therefore ordinarily be shared with the affected seller. This may include your name and contact information.

If you do not want your personal contact details shared, consider submitting the notice through a lawyer or another authorised representative. That representative must provide their own valid contact information and evidence that they are authorised to act for you.

Can I submit a DMCA notice anonymously?

No. A valid DMCA notice must include the claimant’s full legal name and contact information, including an address, telephone number, and email address.

Anonymous complaints or reports that do not identify the person making the legal claim cannot normally be processed as DMCA notices.

You may use an authorised representative if you do not want to submit your own contact information directly.

What if the complaint concerns only one component of a product?

If the complaint concerns a specific image, code file, library, template, font, icon, documentation section, or another separable component, the seller may be allowed to remove or replace that component.

WPBay may review the modified product before restoring it. A counter-notification may not be necessary if the disputed material has been completely removed and the original complaint no longer applies to the revised product.

Replacing a component does not prevent the claimant from pursuing a separate claim concerning its previous use.

I am a seller and disagree with the complaint. Can my product be restored?

You may contact the claimant to resolve the dispute or submit a valid DMCA counter-notification if you genuinely believe the content was removed because of a mistake or misidentification.

A counter-notification is also a serious legal statement. It requires your contact information, consent to the applicable United States federal court jurisdiction, acceptance of service of process, a statement under penalty of perjury, and your physical or electronic signature.

Do not submit a counter-notification simply because you want the product restored quickly. The claimant may begin legal proceedings against you after receiving it.

How long does restoration take after a counter-notification?

WPBay will send a substantially valid counter-notification to the original claimant.

Unless the claimant informs WPBay that they have filed a court action seeking an order restraining the disputed activity, WPBay will generally restore the content between 10 and 14 business days after receiving the valid counter-notification. This timetable follows the Section 512 counter-notification process.

A threat to file a lawsuit is not necessarily sufficient. WPBay may ask for evidence that proceedings were actually filed.

Does a successful counter-notification guarantee restoration?

No. A counter-notification addresses the specific copyright complaint, but the product may remain disabled for another reason.

This may include malware, security risks, fraud, another intellectual property complaint, a court order, repeated infringement, or a breach of the Seller Agreement, Terms and Conditions, or Acceptable Use Policy.

Can the claimant withdraw a DMCA notice?

Yes. The claimant should send a clear retraction to support@wpbay.com, preferably from the same email address used for the original notice.

The retraction should identify the original complaint and affected WPBay URL, state that the notice is being withdrawn, and include the claimant’s full legal name and signature.

A retraction does not guarantee restoration if the product violates another WPBay policy or legal requirement.

Another seller has used code from my plugin or theme. Is that automatically copyright infringement?

Not necessarily. Two WordPress products may legitimately contain similar structures, APIs, hooks, coding patterns, open-source libraries, or functionality.

When reporting copied code, identify the specific original code you own and the corresponding code in the reported product. Repository history, dated source files, release archives, commit records, and other development evidence can help establish when and by whom the code was created.

If the code was distributed under the GPL or another open-source licence, explain which licence condition you believe was violated. Permitted reuse under an applicable licence is not automatically copyright infringement.

WPBay cannot determine ownership merely from the fact that two products perform the same function.

Do I need a copyright registration to submit a notice?

A registration number is not required simply to submit a DMCA notice, but you should include one if the work is registered.

You must still provide enough information to identify the original work and show that you own the relevant copyright or are authorised to act for its owner.

Different requirements may apply if you later decide to bring court proceedings, so obtain independent legal advice where necessary.

Can I use the DMCA process for trademarks, patents, or product names?

No. The DMCA process applies to copyright claims.

Complaints involving trademarks, registered designs, patents, trade dress, business names, passing off, or unfair competition should be submitted as a General IPR Notice using the instructions in our DMCA and Intellectual Property Notice Process.

Does the DMCA process apply if I live outside the United States?

The DMCA is a United States legal process, but WPBay accepts properly prepared copyright notices from rights holders worldwide.

Depending on the claimant, content, and countries involved, WPBay may also process the complaint under other applicable laws, including relevant EU notice-and-action requirements.

A seller submitting a DMCA counter-notification from outside the United States must include the jurisdiction statement specified in the main DMCA process.

My WPBay product is being pirated on another website. Can WPBay remove it?

WPBay cannot directly remove content hosted by another website.

Because sellers retain ownership of their products, you may submit a copyright complaint to the website, hosting provider, search engine, payment provider, domain registrar, or other service involved.

WPBay may be able to provide reasonable evidence relating to your product listing or seller account, but it cannot act as your lawyer or submit a legal notice on your behalf unless a separate arrangement expressly authorises it to do so.

Can I obtain the seller’s private contact information?

You may contact a seller through the contact or support options available on their WPBay profile or product page.

WPBay will not disclose private account information merely upon request. Information may be disclosed as part of the formal notice and counter-notification process, with the seller’s consent, when legally required, or in response to valid legal process.

What happens to a seller’s earnings while a dispute is being reviewed?

Product removal does not automatically determine whether associated earnings must be released.

WPBay may temporarily hold amounts where reasonably necessary to cover refunds, chargebacks, legal claims, suspected fraud, or other obligations permitted by the Seller Agreement and applicable law.

Release of held funds is assessed according to the circumstances. Relevant factors may include a retraction, valid counter-notification, settlement, binding court order, or final resolution of the dispute.

Will a seller’s account be reinstated after a complaint is resolved?

Account reinstatement is considered separately from restoration of an individual product.

WPBay may decline to reinstate an account where there is evidence of repeated infringement, fraudulent behaviour, abusive conduct, security issues, or other serious violations of WPBay’s agreements and policies.

Resolution of one complaint does not automatically resolve unrelated complaints or account violations.

What happens if someone submits a false DMCA notice or counter-notification?

Knowingly making material misrepresentations in a DMCA notice or counter-notification may result in legal liability under 17 U.S.C. §512.

WPBay may also restrict accounts or take other appropriate action where its complaint process is used fraudulently, abusively, or to interfere unfairly with another seller.
