WPBay is operated by CODE IKIGAI SRL. Products offered through WPBay are created and supplied by independent sellers. References to “content” include product listings, downloadable files, source code, documentation, screenshots, previews, images, names, logos, and other material available through WPBay.
This process does not constitute a judicial determination about ownership or infringement. WPBay cannot provide legal advice.
Before submitting a notice
A DMCA notice or counter-notification is a serious legal statement.
Before submitting one, consider whether the disputed material may be:
- Used under a valid licence.
- Open-source software used according to its licence.
- In the public domain.
- Covered by fair use, fair dealing, quotation, interoperability, or another legal exception.
- Material that you do not own or are not authorised to represent.
Knowingly making a material misrepresentation in a DMCA notice or counter-notification may result in legal liability under 17 U.S.C. §512.
Consider obtaining independent legal advice if you are uncertain about your rights.

How to submit a DMCA takedown notice
Use the DMCA process only for copyright claims. Trademark, patent, design, and other intellectual property complaints should follow the General IPR Notice process below.
A valid DMCA takedown notice must include:
- Your signatureInclude your physical or electronic signature. If submitting by email, you may type your full legal name and state that it is your electronic signature.
- Identification of the copyrighted workDescribe the original work you believe has been infringed. Include its title, type, owner, publication date, and a URL showing the original work where available.If the work is unpublished or not publicly accessible, provide another reasonable way for WPBay to verify it, such as ownership records, dated source files, repository history, registrations, or other supporting evidence.
- Identification of the allegedly infringing materialIdentify the exact WPBay content you want reviewed. Include:
- The product or page URL.
- The relevant file, folder, function, image, text, or other component.
- Any additional information needed to locate it.
- An explanation of the claimed infringementExplain clearly how the WPBay content infringes your copyright. Similarity alone may not establish infringement, so identify the original elements you believe were copied or used without permission.

- The date of the notice
If your notice is missing required information, WPBay may ask you to provide or correct it. We will not automatically disregard a notice merely because of a minor formatting error.
What happens after WPBay receives a DMCA notice?
After receiving a notice, WPBay may:
- Acknowledge receipt of the notice.
- Check whether it substantially contains the required information.
- Request clarification, evidence of ownership, or evidence that you are authorised to act for the owner.
- Forward the notice, including relevant contact information, to the affected seller.
- Remove or disable access to the disputed content where appropriate.
- Inform the seller about the action and available response options.
- Preserve relevant records where reasonably necessary.
WPBay does not decide complex copyright disputes as a court would. A decision to disable content does not necessarily mean that WPBay has made a final determination that infringement occurred.
If your WPBay product has been disabled
If you are a seller whose product or content has been disabled following a DMCA notice, you may:
- Accept the notice and leave the disputed content disabled.
- Resolve the matter directly with the claimant and ask them to retract the notice.
- Remove or replace the disputed material, subject to WPBay’s review.
- Submit a valid DMCA counter-notification if you genuinely believe the content was removed because of a mistake or misidentification.
Do not submit a counter-notification merely because you disagree with the claimant or want your product restored quickly. A counter-notification can lead to legal proceedings.
How to submit a DMCA counter-notification
A valid counter-notification must include:
- Your signatureInclude your physical or electronic signature.
- Identification of the removed materialDescribe the content that was removed or disabled and identify the URL or location where it appeared before removal.
- Your statement under penalty of perjuryInclude the following statement:I state under penalty of perjury that I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact informationInclude your:
- Full legal name.
- Postal address.
- Telephone number.
- Email address.
- Consent to court jurisdictionInclude the statement applicable to you:If your address is in the United States:I consent to the jurisdiction of the United States Federal District Court for the judicial district in which my address is located.If your address is outside the United States:I consent to the jurisdiction of the United States Federal District Court for any judicial district in which WPBay may be found.
- Acceptance of serviceInclude this statement:I will accept service of process from the person who submitted the original DMCA notice or from that person’s authorised agent.
- An explanationExplain why you believe the removal resulted from a mistake or misidentification. Include relevant licences, permissions, source files, development history, purchase records, or other supporting evidence.
- The date of the counter-notification
WPBay will send a copy of a substantially valid counter-notification to the original claimant. This means that the seller’s name and contact information will ordinarily be disclosed to the claimant.
What happens after a counter-notification?
After forwarding a valid counter-notification, WPBay will generally restore the affected content between 10 and 14 business days after receiving it unless the claimant informs WPBay that they have filed a court action seeking an order restraining the seller from engaging in the allegedly infringing activity.
WPBay may request evidence that proceedings have actually been filed, such as the court, case number, filed complaint, and parties involved.
Content may remain disabled for separate reasons, including:
- A court or regulatory order.
- Another intellectual property claim.
- A breach of the Seller Agreement, Terms and Conditions, or Acceptable Use Policy.
- Malware, security, fraud, privacy, or consumer-protection concerns.
- Repeated infringement.
- A legal obligation applicable to WPBay.
Retracting a DMCA notice
A claimant may retract a DMCA notice by emailing support@wpbay.com from the same email address used for the original notice.
The retraction should:
- Identify the original notice.
- Identify the affected WPBay URL.
- Clearly state that the claimant retracts the notice and no longer requests removal.
- Include the claimant’s full legal name and electronic or physical signature.
A retraction does not guarantee restoration if the content violates another WPBay policy or legal requirement.
General intellectual property notices
The DMCA process applies to copyright. If you believe WPBay content infringes another intellectual property right, such as a:
- Trademark.
- Registered or unregistered design.
- Patent.
- Trade dress.
- Business name.
- Right relating to passing off or unfair competition.
You may submit a General IPR Notice.

Information required in a General IPR Notice
Your notice should include:
- Your full legal name, address, telephone number, and email address.
- The identity of the rights owner and your authority to represent them.
- A clear description of the intellectual property right being asserted.
- Evidence supporting the existence and ownership of the right.
- The exact URL and location of the allegedly infringing content.
- A detailed explanation of how that content infringes your right.
- The country or territory in which the right is protected.
- The action you are asking WPBay to take.
- A statement that you have a good-faith belief that the information and allegations in the notice are accurate and complete.
- Your physical or electronic signature and the date.
For registered trademarks, include the registration number, owner, jurisdiction, relevant classes, registration status, and a link to the official registry where possible.
General IPR complaints do not follow the DMCA counter-notification timetable. WPBay will assess them according to their circumstances and applicable law. We may request more information, forward the complaint to the seller, invite a response, or restrict the disputed content.
Where applicable, a sufficiently precise notice may also be handled through the notice-and-action requirements in Article 16 of the EU Digital Services Act.

Sharing of notices and personal information
To process a complaint fairly, WPBay may share the notice, counter-notification, supporting evidence, and relevant contact information with:
- The affected seller.
- The claimant.
- Legal representatives.
- Service providers assisting with the investigation.
- Courts, regulators, or law-enforcement authorities where legally required.
Do not include unnecessary sensitive personal information.
If you do not want your personal contact details disclosed, consider submitting the notice through an authorised lawyer or representative. The representative must still provide valid contact information and evidence of their authority.
Personal information is otherwise handled in accordance with WPBay’s Privacy Policy.
Repeat infringement and abusive notices
WPBay may restrict or terminate sellers who repeatedly infringe intellectual property rights, taking into account the circumstances, reliability of the complaints, counter-notifications, retractions, and other relevant evidence.
WPBay may also take action against users who knowingly submit fraudulent, misleading, automated, or abusive notices.
Nothing in this process prevents WPBay from removing content, restricting an account, preserving evidence, or taking other action required by law or permitted under its agreements and policies.
