Any WPBay user or member of the public may report content, products, or services they believe are illegal.
This reporting mechanism is provided in accordance with the notice-and-action requirements of Article 16 of the EU Digital Services Act.
Reports can concern product listings, downloadable files, seller profiles, reviews, messages, images, documentation, links, or other information made available through WPBay.
What is illegal content?
Under the Digital Services Act, illegal content includes information, products, services, or activities that do not comply with applicable EU or national law.
Depending on the circumstances and jurisdiction, this may include fraudulent products or services, scams, phishing, malware, unlawful use of personal information, counterfeit products, prohibited goods or services, unlawful threats, terrorist content, child sexual abuse material, or content that violates another applicable law.
Content that is offensive, inaccurate, low quality, or contrary to someone’s personal opinion is not necessarily illegal. If content violates a WPBay rule but you do not believe it is unlawful, report it as a potential violation of the Acceptable Use Policy through general support.
WPBay cannot provide legal advice or make definitive judicial determinations about complex legal disputes.
Reports covered by another process
Copyright, trademark, patent, design, and other intellectual property complaints should be submitted through WPBay’s DMCA and Intellectual Property Notice Process.
If your WPBay product is being distributed on another website without authorisation, see Protecting Your WPBay Products From Piracy. WPBay cannot remove content hosted by an unrelated external website.
Sellers challenging a product rejection, removal, account restriction, suspension, payout decision, or another marketplace measure may use the EU Platform-to-Business Complaint Process where applicable.
A security vulnerability that does not itself involve illegal content should be reported privately to support@wpbay.com. Sellers should also review the EU Cyber Resilience Act Reporting Requirements.
Customer support disputes, refund requests, product defects, and disagreements with a seller are not automatically illegal-content reports and should normally be submitted through WPBay support.
How to report illegal content
Send your report to support@wpbay.com with the subject:

Reports may be submitted in English or Romanian.
Identify the exact content
Provide the complete URL of the WPBay page containing the reported information.
If the content appears inside a downloadable product, identify the product, file, folder, function, image, documentation section, or other component where it can be found. Include any information reasonably necessary for us to locate it.
A general link to WPBay’s homepage or an entire seller account may not be sufficiently precise.
Explain why you believe it is illegal
Provide a sufficiently detailed explanation of why the reported content, product, service, or activity is illegal.
Identify the country or territory in which you believe the content is unlawful. If you know the relevant law, court decision, regulatory requirement, or legal restriction, include it. You are not required to provide a formal legal analysis, but your explanation must contain enough information for WPBay to understand and assess the allegation.
Clearly distinguish illegal content from material that you merely dislike, consider inappropriate, or believe violates a private agreement.
Provide supporting information
Include screenshots, correspondence, registry records, official decisions, or other evidence that may help us evaluate the report.
Do not send passwords, complete payment-card details, private licence keys, unnecessary identity documents, or malicious executable files.
If the report concerns suspected malware, provide the affected product URL, filename, detection result, file hash, and security-vendor report where available. Do not email an executable malware sample unless WPBay specifically requests it through a secure method.
Provide your contact information
Include your full name and email address. If you are reporting on behalf of an organisation or another person, identify them and explain your authority to act.
WPBay may review anonymous safety information, but a report without adequate contact information may not qualify as a complete notice under the Digital Services Act. We will also be unable to acknowledge receipt, request clarification, or notify you of our decision.
Different identity requirements may apply to reports involving suspected offences concerning child sexual abuse or exploitation.
Include a good-faith statement
Add the following statement:
I confirm that I have a good-faith belief that the information and allegations contained in this report are accurate and complete.

Reports involving immediate danger
If someone is in immediate danger, contact the appropriate emergency service or law-enforcement authority first. WPBay support is not an emergency service and cannot provide an immediate physical response.
If you encounter suspected child sexual abuse or exploitation material, do not download, copy, forward, or attach the material. Report the exact URL and any information needed to locate it. WPBay may preserve relevant records and notify competent authorities as required by law.
What happens after a report is submitted?
Where you provide a valid electronic contact address, WPBay will acknowledge receipt of the report.
We will assess the notice in a timely, diligent, objective, and non-arbitrary manner. The review may consider the information in your report, the reported content, applicable law, the relevant jurisdiction, information from the seller or content provider, and other evidence reasonably available to us.
WPBay may request clarification or additional information. A notice that does not identify the content or explain the alleged illegality may not provide a sufficient basis for action.
Submitting a report does not guarantee that content will be removed. WPBay will not automatically restrict content solely because an allegation has been made.
Actions WPBay may take
Depending on the circumstances, WPBay may remove or disable access to content, restrict its availability in a particular country, remove a product or download, limit its visibility, suspend a transaction, restrict a seller account, preserve relevant records, or notify a competent authority.
WPBay may also determine that the content should remain available because the report is unsupported, incomplete, concerns conduct that is not illegal, or does not establish a sufficient legal basis for restriction.
Where urgent action is necessary to address fraud, malware, security threats, unlawful products, or a serious risk to users, WPBay may restrict the content before completing every part of its review.
When appropriate and legally permitted, WPBay will inform the reporting party of its decision and available review options.
Notification of the affected seller or user
If WPBay restricts content, the seller or user responsible for it will ordinarily receive a statement explaining the main reasons for the decision, the scope of the restriction, whether automated tools materially contributed to the decision, and the available options for review.
Certain information may be withheld where disclosure is prohibited by law, would interfere with an investigation, reveal confidential information, or create a significant safety or security risk.
WPBay may share the substance of a report with the affected seller or user so they can respond. The reporter’s identity and contact information will only be shared where reasonably necessary, legally required, or relevant to a fair assessment of the complaint.
Requesting a review
If you submitted a report and believe WPBay misunderstood material information, reply to the decision email and explain why you believe it should be reconsidered.
A seller or user whose content was restricted may also request a review by replying to the statement of reasons and providing relevant evidence.
A review does not guarantee reversal. Content may remain restricted while the review is pending where WPBay considers this necessary to protect users, preserve evidence, or comply with the law.
Unfounded and abusive reports
Do not use this process to harass a seller, interfere with lawful competition, suppress legitimate criticism, or submit claims you know are false.
Where a person repeatedly submits reports that are manifestly unfounded, WPBay may issue a warning and temporarily suspend or limit the processing of further reports from that person for a reasonable period. Any such decision will take into account the number, seriousness, frequency, and apparent intention of the reports.
Fraudulent reports may also result in account restrictions or legal action where appropriate.
Complaints about WPBay’s DSA compliance
If you believe WPBay has failed to comply with an obligation under the Digital Services Act, you may submit a complaint to the Digital Services Coordinator in your EU Member State.
WPBay is established in Romania. Romania’s Digital Services Coordinator is the National Authority for Management and Regulation in Communications of Romania – ANCOM.
ANCOM supervises compliance with the Digital Services Act but is not generally responsible for deciding whether a particular item of content is illegal or acting as an appeal body for individual content-moderation disputes.
