The WPBay marketplace has two types of violations for copyright infringement, each has a different penalty.
One-Strike Violations
One Strike Violations include, but are not limited to:
- Uploading an item that is not your own creation, and that is being sold on an WPBay Marketplace or elsewhere.
- Uploading an item that is not your own creation, and that is being distributed freely elsewhere WITH a license that prohibits resale or redistribution.
- Uploading an item that contains a virus or other malware.
Penalty: Any seller responsible for such a violation will have their account DISABLED immediately. Any earnings in the account will be held for three years pending any legal action that may be pursued.
Appeals: Appeal can be made for reinstatement by contacting WPBay support. Any seller seeking reinstatement must provide sufficient evidence.
Warning Violations
Certain violations have a less severe penalty. Nonetheless they will lead to action if the seller does not respond and/or take appropriate action.
Warning Violations include, but are not limited to:
- Uploading an item that is the output of a tutorial.
- Uploading an item that is not your own creation, and that is being distributed freely elsewhere WITHOUT an appropriate license.
Penalty: A warning will be issued by email. Offending items will be immediately removed from the WPBay marketplace and when necessary, earnings held for three years pending any legal action that may be pursued. Further violations will results in escalation of penalty.
Appeals: Appeal can be made for a file by contacting support. Any seller seeking a warning to be withdrawn or an item re-enabled must provide sufficient evidence.
