When someone believes that an item on the marketplaces has violated their copyright, we ask that they send support a copyright or DMCA take down notice. A DMCA take down notice is a serious legal document in which an individual swears under penalty of perjury that they are the legal copyright holder to the allegedly infringing item/s.

When WPBay support receives a valid DMCA take down notice, they must immediately:

  1. Remove the item in question from the marketplaces.
  2. Freeze any funds from the sale of the item for a period of 3 years.
  3. In some cases, disable the account from which the item in question was uploaded for sale.
  4. Notify the seller and send them a digital copy of the DMCA take down notice.

How can I unfreeze earnings or have my account reinstated?
The only ways WPBay can reopen an account or release funds after a DMCA notice is sent, is if:

  1. A registered legal body compels WPBay to release the funds or reinstate the account, or
  2. The issuer of the DMCA takedown notice retracts the allegations in writing.

How do you calculate the funds that need to be held on an item?
To calculate the sum of money that needs to be frozen, we multiply the following:

  1. Price of item in dollars for any type of license.
  2. Number of times purchased under any type of license.
  3. Seller’s commission rate at the time of sale.

This sum is then frozen by the WPBay Marketplace for three years pending any legal action. If no action has been taken within 3 years, WPBay will release the frozen funds to the original member on request.
