At WPBay, we respect the intellectual property rights of others, and we expect our users – sellers and buyers alike – to do the same. This page explains how we handle copyright infringement claims under the Digital Millennium Copyright Act (DMCA) and similar international laws.
If you believe that content on WPBay infringes your copyright, you can submit a takedown request. We’ll investigate and take appropriate action.
1. Before You File a Claim
We strongly encourage you to:
- Make sure you actually own the rights to the content in question.
- Consider whether the use may fall under fair use (e.g. reviews, educational commentary).
- Contact the uploader directly if possible. Many disputes can be resolved without filing a formal complaint.
If you’re certain that a product or listing infringes your copyright, you may proceed to file a formal takedown request as described below.
2. How to Submit a Takedown Notice
To submit a DMCA takedown request, email [email protected] with all of the following information:
- Your full legal name and contact information (email address and phone number).
- A link to the original copyrighted work (or detailed description if not available online).
- A link to the allegedly infringing content on WPBay.
- A brief explanation of why you believe the content infringes your rights.
- A statement under penalty of perjury that:
- You have a good faith belief the content is not authorized by the copyright owner.
- The information you’ve provided is accurate.
- A statement that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature (typing your full name is acceptable if sent by email).
Incomplete or vague notices will be ignored.
3. What Happens Next
Once we receive a complete and valid DMCA notice:
- We may temporarily remove or disable access to the allegedly infringing content.
- We’ll notify the user who uploaded the content and share the details of your claim.
- If the user believes the takedown was in error, they may file a counter-notice (see below).
4. Counter-Notice Process
If your content was taken down and you believe this was a mistake or you have the legal right to use it, you may submit a counter-notice to [email protected] with:
- Your full name, address, and contact info.
- A description of the material removed and its original location.
- A statement under penalty of perjury that:
- You believe the content was removed in error.
- You consent to the jurisdiction of your local federal court (or Bucharest Tribunal if outside the U.S.).
- Your physical or electronic signature.
If we receive a valid counter-notice, we may restore the content unless the original claimant files a court action within 10 business days.
5. Repeat Infringers
Users who repeatedly upload infringing content may have their accounts suspended or permanently banned from WPBay. This applies regardless of intent.
6. Important Notes
- Filing a false DMCA notice is a legal offense and may result in damages.
- WPBay does not mediate disputes – we handle DMCA requests based on the legal process.
- This process is meant for copyright claims only – not for trademark disputes, personal conflicts, or business disagreements.
