An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. Media

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

DAC7 Reporting (EU Tax Transparency for Platform Sellers only)

Wpbay, as a Romania-based online marketplace and “reporting platform operator” under Council Directive (EU) 2021/514 (“DAC7”), is required by EU law to collect, verify, and report certain information about sellers who carry out “relevant activities” on our platform to the Romanian tax authorities (ANAF – Agenția Națională de Administrare Fiscală).

This reporting supports tax transparency and helps prevent tax evasion by enabling automatic exchange of information between EU Member States’ tax authorities. DAC7 does not impose any new tax on sellers – it only requires us to share existing data for tax assessment purposes.

What Data We Collect and Report Under DAC7

We collect and may report the following information for reportable sellers (primarily individuals or entities resident in an EU/EEA Member State, or conducting relevant activities affecting EU users, who exceed reporting thresholds such as more than 30 transactions or €2,000 in gross consideration per calendar year for goods sales; no threshold for certain personal services, property, or transport rentals):

  • Personal identification data: Full legal name, primary address, date of birth (for individuals).
  • Tax-related data: Tax Identification Number (TIN), VAT identification number (if applicable), business registration number (for entities).
  • Financial data: Financial account identifier(s) (e.g., IBAN or other bank details used for payouts).
  • Platform activity data: Member State(s) of tax residence, total consideration (gross amount paid minus fees/commissions), number of transactions/relevant activities per reporting period.

We only collect data that is strictly necessary to comply with DAC7 (“data minimization” under GDPR).

Legal Basis for Processing

The processing of your personal data for DAC7 purposes is based on our legal obligation to comply with EU and Romanian tax law (Art. 6(1)(c) GDPR, in conjunction with Directive (EU) 2021/514 and Government Ordinance no. 16/2023 in Romania).

Who Receives Your Data

  • We report the required information annually to ANAF by 31 January of the year following the reporting calendar year (e.g., data for 2025 reported by 31 January 2026).
  • ANAF may automatically exchange this information with the tax authorities of other EU/EEA Member States where you are tax resident or where relevant activities occur.
  • We do not share this data with third parties for commercial/marketing purposes under DAC7.

Retention Period

We retain DAC7-related data for as long as required by Romanian tax law – typically 10 years from the end of the relevant calendar year (or longer if required for audits/disputes). After this period, the data is securely deleted or anonymized unless another lawful basis applies.

Your Rights Under GDPR

You have the following rights regarding your DAC7 data (subject to limitations where data is processed to comply with legal obligations):

  • Right to access, rectification, or erasure (erasure may be restricted if data is still needed for tax compliance).
  • Right to restriction of processing.
  • Right to data portability (where technically feasible).
  • Right to lodge a complaint with the Romanian Data Protection Authority (ANSPDCP – Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal) or your local supervisory authority.

  • We make best efforts to verify the accuracy of collected data (e.g., via official registries or TIN validation tools), as required by DAC7.
  • If you fail to provide required information after reminders, we may restrict or close your seller account or block any withdrawing of funds from your account (as per DAC7 and our Terms of Service).
